Resumo Este artigo tem por objetivo analisar as respostas das agências reguladoras federais para o enfrentamento da crise de saúde pública gerada pelo novo coronavírus. Parte-se do entendimento de que a avaliação empírica dos padrões de resposta evidenciados pelas agências durante a crise da COVID-19 cumpre um papel importante no aprimoramento da função pública. Em primeiro lugar, porque oferece subsídios para que a própria atividade regulatória se adapte de forma mais célere às necessidades do atual momento de crise. Em segundo, porque o contexto excepcional gerado pela pandemia coloca em evidência alguns traços essenciais da atividade regulatória: suas condições de exercício e funcionalidades, suas limitações e potencialidades e, sobretudo, sua importância para a minimização de danos em cenários marcados por instabilidade estrutural. Os dados utilizados no presente estudo foram extraídos do Diário Oficial da União (DOU) e dos sítios eletrônicos das 11 agências reguladoras federais. Para a presente análise, foram selecionadas apenas as medidas com efetivo impacto regulatório sobre o setor regulado. Identificamos uma significativa heterogeneidade no volume de respostas das agências, em parte relacionada a diferenças setoriais, mas sobretudo decorrente de assimetrias na capacidade institucional desses órgãos. Identificamos também uma heterogeneidade no conteúdo das respostas das agências a problemas regulatórios semelhantes, evidenciando falhas de coordenação regulatória que precisam ser urgentemente solucionadas.

Acordos substitutivos podem ser utilizados como alternativa regulatória ambiental em matéria de compensação por ato lícito e por ato ilícito. São há muito aceitos pelas normas de Direito Ambiental em ambos os casos, mas praticados pela Administração Pública apenas mediante compensação por ato lícito, ou seja, por impacto ambiental. Falta de segurança jurídica constituiu histórico obstáculo à ampla utilização deste instrumento de regulação ambiental. A consensualidade vem sendo tratada como uma nova tendência pela moderna teoria de Direito Administrativo. A regulação ambiental serve de estudo de caso para demonstração da efetividade dessa alternativa regulatória na maximização do interesse público a partir da análise de conveniência no caso concreto. Recentes alterações normativas no Direito Ambiental, promovidas pelos Decretos 9.179/17 e MP 809/17, podem aumentar a segurança jurídica para otimização e promoção dos acordos substitutivos na regulação ambiental. Podem servir também de referencial normativo para outras áreas reguladas, potencializando o interesse público pela consensualidade.
A atuação do Tribunal de Contas da União vem ganhando maior repercussão nos círculos jurídicos e na opinião pública de maneira geral. A despeito de sua relevância para a ordem democrática brasileira e de seu papel para o controle externo, na fiscalização contábil, financeira e orçamentária da Administração Pública, o Tribunal de Contas da União raras vezes foi objeto de um estudo quantitativo de escala. É fundamental conhecer a realidade quantitativa do trabalho desempenhado pelo Tribunal, especialmente sob o ponto de vista da sua gestão. Esse artigo pretende responder a seguinte pergunta: qual é o perfil de tipo e tempo de tramitação dos processos no TCU nos últimos 25 anos? A metodologia empregada é de análise quantitativa de uma base de dados contendo todos os processos protocolados no TCU de 1994 a 2018, obtida diretamente do site do Tribunal. Os dados permitem identificar duas tendências. A primeira é que a carga de trabalho do TCU, medida pelo número de processos novos, quintuplicou em duas décadas. Não se vislumbra como alternativa de fácil e sustentável implementação que a equipe do Tribunal, incluindo o número de ministros, simplesmente seja ampliada para acompanhar sempre o crescimento do número de processos. A segunda tendência é de melhora significativa na gestão dos processos no TCU, largamente aprimorada com a implementação do processo eletrônico. Ainda que o novo sistema não tenha sido capaz de reduzir para um ou dois anos o tempo de duração de processos de análise de contas – que seria desejável, mas não necessariamente factível dada a complexidade inerente do tipo de processo – seu impacto nas demais classes processuais com grande volume de processos no Tribunal foi altamente positivo.

The United States of America was structured in the form of a federation, inspiring Brazilian republican (1891). The US bureaucracy was structured through independent agencies external to the Executive Branch, forming the Administrative State. This article intends to investigate the emergence and evolution of the US Administrative State model and whether this model had influence or not in the Brazilian bureaucracy.
