Resumo O ensaio enfrenta criticamente as mudanças trazidas pela economia digital e suas plataformas digitais no Direito do Trabalho. Cuida da noção de plataforma de trabalho a partir de tipologias e modelos, inclusive quanto às categorias de trabalho online e offline. Confronta o papel do Direito do Trabalho com as perspectivas de regulação do assalariamento nestas plataformas, e reflete sobre a relação entre precariedade, tecnologia e seus fetiches.
A partir do marco teórico das tradições democráticas e, numa abordagem neoinstitucionalista, este artigo tem por objetivo destacar os sentidos da reconfiguração do Direito do Trabalho presentes nas disputas sobre a terceirização no Brasil. Para tanto, procede a uma pesquisa sobre o tema nas principais arenas, legislativa e judicial, por meio da análise da produção das normas em suas relações com as instituições e os agentes sociais. Como resultado, aponta para a ilegitimidade das mudanças institucionais pautadas na racionalidade econômica do mercado, em detrimento daquelas conformadas em arenas democráticas e estabelecidas na Constituição da República Federativa do Brasil.
O Programa Emergencial de Manutenção do Emprego e da Renda foi uma política pública instituída pelo governo brasileiro em reação às consequências deletérias da pandemia de Covid-19 sobre o mercado de trabalho. O presente artigo tem como objetivo analisar as disputas jurídicas em torno da implementação do Programa Emergencial através de negociações coletivas. A pesquisa foi realizada por meio de: 1) levantamento de contratos coletivos no Sistema Mediador do Ministério da Economia, em que foram encontrados 152 instrumentos coletivos referentes ao programa no município do Rio de Janeiro, firmados entre abril e setembro de 2020; e 2) entrevistas com sindicalistas e advogados de sindicatos que participaram de negociações coletivas relativas ao programa. Os achados da pesquisa apontam para a importância da atuação dos sindicatos na regulação do trabalho e para as consequências do Programa Emergencial em termos de insegurança jurídica e ontológica, uma vez que ele permitiu a suspensão de contratos de trabalho e a redução de jornada e de salário em plena pandemia. Nesse contexto, intensificou-se o unilateralismo patronal como eixo decisório nas negociações coletivas e direitos fundamentais dos trabalhadores foram negociados sob o manto de uma regulação do trabalho de crise.
O artigo examina as respostas às demandas que envolvem a terceirização no cenário pós-reforma trabalhista. Os julgamentos do Supremo Tribunal Federal (STF) – que rechaçou as alegações de inconstitucionalidade da legislação, declarou a licitude da terceirização e superou a distinção entre atividades empresariais acessórias e finalísticas – colocaram um ponto final no debate judicial? Utilizando os procedimentos metodológicos de levantamento jurisprudencial e análise documental, com mapeamento de ações julgadas no último biênio, examinamos os argumentos nos litígios, investigando acerca da modificação em padrões decisórios. A pesquisa conclui que as controvérsias sobre fraudes em terceirização permanecem em disputa na Justiça do Trabalho, submetida ao controle do Supremo, que apresenta posições contraditórias em relação a esse aspecto. Outro achado da pesquisa é que o requisito da “capacidade econômica” está ausente do debate. A emergência de questões fáticas, as fricções entre a Justiça do Trabalho e o Supremo e os argumentos sobre responsabilidade empresarial apontam para a persistência de disputas na arena judiciária mesmo após o novo marco regulatório.
