This article presents a general overview of Brazilian sociolegal studies. After presenting a short historical narrative of the field in Brazil, we argue that the early years of intense teaching of legal sociology had a politically committed approach, which gave rise to growing criticism of Brazilian legal scholarship that in turn affected the self-image of law professors. Different theoretical strands appeared in the years that followed, and some specific fields of research gained importance, particularly those concerning a sociology of the legal profession, the administration of courts, and law schools. However, we contend that as time went by, many sociolegal scholars began to neglect the critical approach to law, and today most of them fail to confront critical aspects of the gap between law on the books and law in action, especially when that gap affects lower classes or stigmatized populations. 91 Annu. A retórica do direito à saúde no Supremo Tribunal Federal * The rhetoric of the right to health in the Supreme Court Resumo Propõe-se no artigo haver déficit decisório do Supremo Tribunal Federal em questões envolvendo a política pública que concretiza a previsão constitucional de direito à saúde, devido à utilização de palavras avaliatórias nas fundamentações das decisões. Sustenta-se que as decisões devem ser tomadas levando-se em conta os dados e fatos contingentes das políticas públicas, tais como as restrições financeiras, as consequências econômicas, as regras específicas aplicáveis à política pública e a possibilidade de isonomia das decisões. Apresentam-se exemplos de decisões que ilustram a aludida prática de fundamentação insuficiente.
Este trabalho é o resultado das investigações sobre a forma como o Supremo Tribunal Federal trata a judicialização das políticas públicas, em especial as de natureza prestacional. O texto que se apresenta é parte do processo de investigação realizado no âmbito do Grupo de Estudo e Pesquisa em Hermenêutica e Políticas Públicas do UniCEUB, e nele se encontram as re exões preliminares sobre a intervenção judicial nas políticas públicas, o conceito, as etapas, a metodologia de análise de políticas públicas, dimensão constitucional e o papel dos juízes na sua efetivação.
This article suggests that a critical approach as the CLS could have deeper and stronger impact on the transformation of reality if it embraced a concept of linguistic coherence on a basic level. It presents a general critique of Brazilian Courts decision-making process and a claim that in cases in which evaluative words and expressions are at stake, there is an implicit duty of using an extra step on the reasoning in order to translate those words and expressions into descriptive ones. That practice permits accountability and transparency of the use of power by judges and decision-makers in general.
