Mediante el presente trabajo se pretende proyectar un análisis del delito de prevaricato concentrándose en las actuaciones que comprenden las decisiones de los jueces ya que el contenido de los artículos 268 y 269 del Código Orgánico Integral Penal, se refieren también al prevaricato de los árbitros y abogados. El objeto de estudio es principalmente el derecho penal; sin embargo, se abordarán antecedentes históricos y doctrinarios para entender el alcance de su tipificación, tomando en consideración criterios subjetivos y objetivos, la realidad histórica y factores políticos y sociales que influyen en las decisiones tomadas por los servidores judiciales (jueces) en la emisión de los autos y sentencias orales y escritos.
El problema de este estudio se relaciona con la educación superior y la docencia en universidades ecuatorianas, que se resiste a romper paradigmas establecidos; por ello, las leyes científicas no deben ni pueden tener fin ni término, al igual que el conocimiento impartido al estudiante. Se presenta un esquema para llegar a confirmar el estado de la ley científica que no es otra cosa que una regularidad de la naturaleza que podemos comprobar desde la praxis y verificar empíricamente.
El presente trabajo contribuye al área del derecho penal con la finalidad de entender los límites del delito de estafa con base en las corrientes doctrinarias que se encuentran desarrolladas por el derecho en su literatura con relación a los delitos al patrimonio económico de las personas que se ven comprometidos por esta acción lesiva y delictiva. Se desarrolló un análisis de los elementos onstitutivos del delito de la estafa que en nuestra legislación se encuentra contenida en el artículo 186 del Código Orgánico Integral Penal. Se establecen los sujetos activo y pasivo en la ejecución del ilícito, considerando la tipología de la estafa, su estructura dogmática y axiológica.
El martes 11 de junio 2019 cinco Vocales de la Corte Constitucional de un total de nueve, tomaron una decisión que no les compete, la investigación analiza los condicionamientos legales y los referentes doctrinarios desde una perspectiva crítica, concluyendo la inviabilidad jurídica de la decisión judicial contraviniendo la letra de la constitución.
