Resumo Em 5 de novembro de 1897, o então presidente da república, Prudente de Morais, escapou de um atentado contra sua vida quando participava de uma cerimônia para receber as tropas oficiais que regressavam vitoriosas do Arraial de Canudos. O anspeçada alagoano Marcelino Bispo de Mello foi prontamente identificado como autor da tentativa de assassinato, mas a suposta ameaça de uma conspiração para destituir o presidente levou à detenção e posterior acusação de dezenas de opositores políticos. Embora esse episódio tenha sido tematizado diversas vezes em investigações sobre a história política, social e cultural das primeiras décadas da Primeira República, ele foi pouco explorado desde uma perspectiva jurídica. Neste artigo, analisarei duas ações judiciais que representaram o cerne das disputas legais em torno da tentativa de assassinato - o habeas corpus e o processo crime. Como buscarei demonstrar, uma análise enfocada nesses documentos abre uma série de possibilidades tanto para visualizar as lógicas, conceitos e procedimentos por meio dos quais direito penal e política eram postos em relação, quanto para entender o processo de construção social do direito penal durante a Primeira República.
