O presente artigo tem por objeto o inquérito policial, em especial o indiciamento do acusado. O objetivo do trabalho é analisar, de forma didática, os aspectos gerais do inquérito policial sob a ótica democrática, expondo o seu caráter estigmatizador e invasivo sobre a esfera jurídica do indivíduo. Busca-se ainda demonstrar a importância dos níveis de controle do poder punitivo, especialmente do indiciamento formal, como instrumento para a limitação da seletividade do inquérito e sua instrumentalização política. Para a articulação dos argumentos, o trabalho se valeu da metodologia do pensamento orientado a problemas, de modo a aproximar as reflexões teóricas da prática, demonstrando sua relevância concreta. Para responder aos problemas expostos, propõe-se a realização de uma investigação teórica, com prioridade para a análise de conteúdo com vistas à compreensão crítica do tema-problema e à elaboração de propostas de solução para o caso apresentado. Dessa forma, a proposta consiste em uma pesquisa de vertente jurídico-dogmática, de tipo compreensivo-propositivo, em que predomina a utilização do raciocínio indutivo-dedutivo. Os resultados apontam para a urgência das reflexões sobre a justiça procedimental no processo penal, percebendo que método e respeito às determinações formais dos atos que compõem os procedimentos criminais são os elementos que conferem segurança jurídica ao indivíduo, bem como afastam os riscos de instrumentalização do aparato Estatal para fins políticos ou para a simples satisfação de desejos e expectativas retributivas da sociedade.
Resumo: A intensificação das interações a nível mundial conferiu ao Direito Comparado um novo destaque e relevância, do qual emergem diversos questionamentos, principalmente acerca de quais as formas de empreender um estudo comparado de forma consistente e segura. O presente trabalho busca sistematizar, de modo didático, diferentes métodos do Direito Comparado, evidenciando suas técnicas, suas vantagens e seus perigos. Dessa forma, pretende-se auxiliar estudantes e pesquisadores interessados na pesquisa comparada, chamando atenção para os cuidados a serem tomados para que se evitem problemas na comparação. Foram analisados os métodos funcionalista, estruturalista e hermenêutico, apontando as hipóteses em que cada um desses pode ser melhor empregado. O Direito Comparado pode ser um instrumento profícuo de reflexão sobre o direito do outro e sobre o próprio ordenamento, além de permitir o aprimoramento das instituições e institutos, desde que observados cuidados imprescindíveis para assegurar sua coerência. O estudo de cada um desses métodos permite ao comparatista melhor compreender sua própria análise e evitar problemas que comumente se identificam na aplicação desses métodos. Por fim, a título conclusivo, aponta-se que a adoção de um pluralismo metodológico e de um comparativismo crítico, que conjuguem as principais vantagens de cada método para a análise a ser realizada, pode fornecer a melhor opção àquele que pretende enveredas pelos caminhos da comparação jurídica.
Analisa-se a eficácia democrática desenvolvida pelo contraditório no processo penal. Parte-se da hipótese de que o princípio, enquanto direito humano, autoriza a atuação do acusado para além da estrita legalidade, de modo a fazer valer sua participação de modo pleno e efetivo. Compreendendo a geometria do processo penal em sua singularidade, caracterizada pela desigualdade apriorística entre as partes, buscar-se-á demonstrar que a legitimidade da atuação do Ministério Público decorre de seu vínculo de representatividade com a sociedade, estando, por essa razão, adstrita à legalidade, enquanto o acusado tem sua atuação legitimada pelo direito humano do contraditório. Trata-se de pesquisa de vertente jurídico-dogmática, de tipo compreensivo-propositivo, desenvolvida em uma investigação teórica, com prioridade para a análise de conteúdo.
