Our study seeks to identify the material connection between capitalism and human rights of solidarity. These rights, according to legal theory and international declarations, by contemplating the whole mankind, by conceiving human gender as a law subject, are the highest expression of the progress of human conscience concerning human dignity and the threats against collective life on Earth. We propose, on the contrary, that human rights of third generation express the most abstract forms of capitalism after the Second World War, specially those who correspond to finance and to capital globalization. The internationalized bourgeoise society has become itself more abstract in its fundamental categories, and legal categories have followed the same movement. And in a similar way to what happens to human rights of first generation and second generation, the charming words presented by legal humanism discreetly bear capitalist exploitation. The rights to the common heritage of mankind, to a clean environment, to development and even the right to peace, each one of them reproduce the means of capitalist appropriation and organization of imperialism -the same means which support private profits and collective goods, which maintain imperialist domination and which prepare wars inside the system of states. The idealism and the romantic view about human rights hide this contradiction, and it is necessary to expose it, it is necessary to overcome legal ideology. Our marxist criticism, performed by the critique of capital and its legal form on international scale, is an effort towards this direction.

O artigo concebe a ética como uma forma social profundamente conectada com o capitalismo, tal como o direito, de acordo com a perspectiva de Evgeni Pachukanis. Tal abordagem leva à percepção de que o pensamento moral de Aristóteles não pode ser propriamente considerado como “ético”, pois está baseado na desigualdade da escravidão, e não na igualdade capitalista do sujeito jurídico e ético na modernidade.
O objetivo do presente artigo é identifi car uma conexão entre as formas capitalistas de controle e infl uência sobre a sexualidade e a disciplina do trabalho que é própria da sociedade burguesa e de sua ideologia. Deve-se considerar, como ideologia, uma compulsão interna que coloca o sujeito em movimento e que o constitui como um ente autômato dessa sociedade, capaz de entregar voluntariamente sua força de trabalho no mercado, livre de coerções externas e extraeconômicas. A categoria do trabalho, sob o modo capitalista de produção, está inevitavelmente associada à forma valor, assim como o valor está associado aos padrões de gênero da modernidade. Esse arranjo social conspira contra a livre fruição das novas identidades sexuais, já que a ordem social burguesa impõe normas heterossexistas,encontrando suporte relativo na família nuclear tradicional para fins de garantir a reprodução ampliada da força de trabalho. Portanto, o artigo pretende demonstrar que as restrições sociais à diversidade sexual estão enraizadas na sociedade burguesa, particularmente nas suas categorias constitutivas.
RESUMO O artigo apresenta o tema da violência no sujeito de direito investigando o liberalismo de John Locke. Esse filósofo oferece uma concepção de propriedade que provê um elevado status para as medidas individuais de autotutela, de tal modo que uma agressão violenta contra direitos de propriedade poderia autorizar a vítima a matar o agressor. Segundo Locke, esse tipo de violação provoca um estado de guerra entre esses indivíduos. Isso significa que o moderno sujeito jurídico porta um oblíquo direito de matar por sua propriedade, o que o qualifica como um agente social possessivo e potencialmente violento. Essa violência está enraizada no liberalismo e pode ser explicada pelas características sociais do sujeito jurídico: um ser abstrato que é qualificado como proprietário de sua própria pessoa e dos bens que ele leva livremente (contratualmente) ao mercado para pessoas livres como ele, e igualmente proprietárias das mercadorias que vendem. Espera-se que esse tipo de agente defenda seus bens contra agressões externas quando o Estado falha em prover proteção policial, e a única finalidade do Estado, numa perspectiva liberal, é o fornecimento desse serviço. Tal circunstância revela uma similaridade morfológica entre o sujeito de direito e o homem armado movido pelo autointeresse. PALAVRAS-CHAVE: Sujeito de direito. Violência. Locke. Propriedade. Liberalismo. ABSTRACTThe article presents the theme of violence in legal subject by investigating John Locke's liberalism. This philosopher offers a conception of property which provides a high status for individual measures of self-protection, in such a way that a violent aggression against property rights could allow the victim to kill the aggressor. According Locke, this kind of violation provokes a state of war between these individuals. This means that modern legal subject carries an obliquous right to kill for his property's sake, which qualifies him as a possessive and potencially violent social agent. This violence is rooted in liberalism and can be explained by the social features of legal subject: an abstract being that is qualified as owner of his own person and the goods that he takes freely (contractually) to the market to free people like him, and equally owners of the commodities they sell. This kind of agent is supposed to defend its goods against external aggressions when state fails to provide police protection, and the only purpose of state, in a liberal perspective, is the provision of this service. Such circumstance reveals a morphological similarity between a legal subject and an armed man moved by self-interest
