Forest management in Java currently tends to be centralized. It is implemented in a top-down manner with state-based forest resource management, causing conflicts in the community. Thus, there needs to be a new paradigm, which is society-based forest management. The objective of this research is to analyze the society-based forest management in Ngawi Regency, East Java, Indonesia from a legal perspective. The legal perspective of society-based forest management is the essence of this policy because, without legal support, the management would be illegal. This study used the socio-legal research approach, with a naturalistic qualitative method. The results show that from the perspective of the legal implications, society-based forest management brings society benefits in the economic aspect. Such a benefit encourages society to protect the forest because it is more profitable for them if the forest is protected rather than destroyed. In the social aspect, it increases the welfare of the people. There is also legal certainty in the form of a cooperation agreement between the company and the forest farmers. In the ecological aspect, it contributes to forest preservation as forests are better maintained.
This study aims to map and analyze the forms, factors, and implications that cause stakeholder resistance to istishna' financing policies at Indonesian Syariah Bank in Palu and Jakarta. Data collection techniques were carried out using interview and library techniques. Data analysis uses content analysis with an objective approach to place the results of interviews and literature against each other. The data sources used are a collection of interviews and literature reviews. The results showed that there had been stakeholder resistance to istishna' financing in the two Indonesian Syariah Bankdue to being treated unfair in the form of an increase in the price of goods orders according to the length of instalments, the reworking of goods orders that were not by stakeholder tastes, and delays in delivering goods orders to stakeholders after falling. Tempo in the form of an additional budget to stakeholders. In addition, it is also found that the istishna financing process is complex, the risk of which is dominated by the burden on stakeholders. In addition, the narrowing of the istishna' financing target in the form of micro even though public interest and maqhasid sharia require a macro. Internal and external resistance factors cause stakeholder resistance to the istishna financing policy. These two factors have implications for the circulation of funds in Indonesian Syariah Bankin Palu and Jakarta, which take a long time, are unreliable, have the opportunity to go bankrupt, and take into account the possible risks that cause stakeholders' interest in using istishna financing to decrease. Actions must be taken against stakeholder resistance who experience istishna financing policies in the two Indonesian Syariah Bank, the prohibition of instalments if it causes an increase in the price of the order, the product must be completed at maturity, the product must be following the taste/agreement, there should be no additional funds due to the demand not following the agreement/customer's taste.
Abstrak: Bank Syariah Mandiri merupakan bank milik pemerintah yang pertama kali menerapkan sistem syariah. Dalam perjalanannya, bank plat merah ini mengaplikasikan salah satu sistem kerja sama dengan nasabah yang disebut muḍārabah. Aplikasi sistem muḍārabah juga dilakukan Bank Syariah Mandiri Cabang Palu, yang didirikan pada 2003. Penelitian ini membahas teori muḍārabah dan aplikasi sistem muḍārabah tersebut oleh Bank Syariah Mandiri Cabang Palu. Dari penelitin ini ditemukan bahwa aplikasi sistem muḍārabah pada bank Syariah Mandiri Cabang Palu belum sepenuhnya diwujudkan secara murni sesuai dengan landasan teoretik sistem muḍārabah yang dikemukakan para ahli, meskipun komitmen Bank Syariah Mandiri Cabang Palu kepada nasabah mengalami peningkatan secara signifikan.Abstract: B a n k S y a r i a h M a n d i r i i s a s t a t e b a n k w h o f i r s t introduced a system of sharia. In a way, this bank was applying one system of cooperation with customers called muḍārabah. The systems of muḍārabah are also applicated in the Bank Syariah Mandiri Branch Palu, which was established in 2003. This study discusses the theory and application of muḍārabah system in Bank Syariah Mandiri Branch Palu. The results showed that the application of muḍārabah system in Bank Syariah Mandiri Branch Palu has not been fully realized purely in accordance with the theoretical foundation of muḍārabah system suggested by experts, despite the commitment of Bank Syariah Mandiri Branch Palu to customers has increased significantly.Kata Kunci: aplikasi, sistem muḍārabah, Bank Syarih Mandiri.
The aim of this paper is to study the implementation of Wadiah Product at an Islamic Bank in Indonesia. Bank Syariah Mandiri is the first government bank that operates according to the Islamic Syariah system in Indonesia. The Bank Syariah Mandiri provides wadiah products to serve its customers who are concerned with a free interest product in a financial transaction. This study was carried out with a qualitative method, and the data were gathered through in-depth interviews with the bank staff and manager, observation, and written material. The results of this study show that wadiah application in Bank Syariah Mandiri of Palu runs in accordance with the Syariah principles of Islamic Law. The results of this study also show that costumers lack knowledge regarding how to access the wadiah product. Then the Muslim community preferences in wadiah savings products is still relatively small because Muslim society perceived the profit sharing at the Islamic bank is lower compared to similar products from conventional banks.Further study may focus on Islamic banks customers perception of the wadiah product.
