En Argentina la normativa vigente desde 1998 para la integración escolar se basa en un paradigma educativo-curricular según el cual las necesidades educativas especiales son comprendidas dentro de un modelo biopsicosocial de abordaje, por lo que el retardo mental debería ser entendido como el resultado variable de la interacción entre las capacidades intelectuales del niño y el ambiente. Con el objetivo de indagar la relación entre la normativa, los discursos y las prácticas docentes en la integración escolar de niños con retardo mental, se realizó un estudio transversal-descriptivo. El mismo abarcó el análisis de la normativa de la Provincia de Buenos Aires, entrevistas en profundidad a directivos y docentes de instituciones educativas especiales y comunes, e inspectores de la rama especial y el análisis de proyectos individuales de integración. Los resultados ponen de manifiesto que, si bien la normativa propone un cambio de paradigma en el abordaje de la discapacidad y consecuentemente de la integración, aún no se ha logrado un cambio pleno en las prácticas, advirtiéndose rupturas entre discursos docentes acordes a la normativa y el trabajo áulico anclado todavía en un paradigma médico-psicométrico. De acuerdo con los resultados presentados se considera imprescindible integrar prácticas y nociones, conductas y representaciones, por lo cual la nueva normativa debería ir acompañada de un cambio de acciones que permitan una ruptura con el modelo anterior.
Nos proponemos reflexionar sobre la relación entre autonomía progresiva y vulnerabilidad en el marco de una Bioética de los derechos humanos, teniendo en cuenta los cambios legales ocurridos en Argentina paulatinamente. De acuerdo con Jan Solbakk(2011) (1), el principio de vulnerabilidad, que completa el insuficiente principialismo clásico, ha sido caracterizado de diferentes maneras, como muy amplio y vago o desde un enfoque restrictivo, limitándolo a la toma del consentimiento informado, que incluía a los menores de edad como imposibilitados de otorgarlo por sí mismos. Desde el “supra reconocimiento” de la autonomía progresiva en la Convención de los Derechos del Niño -CDN-, centrado en su interés superior, su derecho a ser oído y a ser tenida en cuenta su opinión de acuerdo al grado de evolución de sus facultades, es imperioso un abordaje de la vulnerabilidad más flexible. En especial en escenarios de salud pública donde la relación entre autonomía progresiva y vulnerabilidad muestra las tensiones más sensibles, donde concurren pacientes menores, provenientes de contextos de marginación, exclusión social y pobreza.
La integración escolar de niños con necesidades educativas especiales es una práctica actual y vigente. Sin embargo, todavía subsisten fuertes obstáculos para el logro de su plena aplicación, ya que aceptar la diversidad supone una transformación de las culturas institucionales y las estructuras educativas. El objetivo del trabajo fue indagar la percepción social sobre el proceso de integración escolar en docentes del Nivel Inicial de Educación. El estudio abarcó 15 entrevistas en profundidad y 170 encuestas a directivos, docentes y personal auxiliar de Instituciones Educativas Municipales de la ciudad de Mar del Plata. El análisis de los datos permitió delimitar algunos de los factores que obstaculizan el proceso de integración escolar: insuficiente coordinación entre las instituciones educativas participantes; falencias en los programas de formación del Profesorado de Educación Inicial respecto de contenidos curriculares específicos; conflictos en la dinámica funcional interna de las Instituciones y dificultades en las distribuciones y disposiciones estructurales y edilicias de los espacios escolares. Se considera indispensable que, a medida que se avanza en el proceso de integración, se trabaje activamente en la resolución de los problemas agrupados en los tres factores anteriormente descritos, logrando una mayor y mejor coordinación entre la escuela común y la escuela especial, brindando la formación académica adecuada a los profesionales que están implicados en esta tarea y mejorando la dinámica de trabajo de todos los actores involucrados en el proceso.
ResumenNos proponemos reflexionar acerca de la relación entre dos principios bioéticos fundamentales en el ejercicio del derecho a la salud: el principio de autonomía y el de vulnerabilidad, en el marco de cambios legales en salud ocurridos en las últimas décadas en Argentina. El respeto a la vulnerabilidad comienza a consolidarse no sólo como el reconocimiento al principio más esencial de la Bioética sino como la base de toda la ética. La vulnerabilidad de individuos y poblaciones requiere una concepción de autonomía que implique en sí misma la inclusión. Se presentan algunas reflexiones y resultados de un proyecto de investigación realizado en 2018-2019 desde la Universidad Nacional de Mar del Plata, que analiza este tema a partir de la percepción de los profesionales de la salud pública en el Partido de General Pueyrredón, provincia de Buenos Aires, Argentina. AbstractWe propose to reflect on the relationship between two fundamental bioethical principles in the exercise of the right to health: the principle of autonomy and that of vulnerability, within the framework of legal changes in health that have occurred in recent decades in Argentina.
