El objeto de este estudio consiste en discernir si el papel que ostenta en la actualidad la autoridad laboral como órgano residual tutelador de la legalidad del expediente del procedimiento de despido colectivo, tras la desaparición de la autorización administrativa, ha contribuido a reducir o potenciar el control judicial, en cuanto a la constatación de las causas, y su concreción, y por ende, la seguridad jurídica y la celeridad del procedimiento a seguir, pues la mayoría de las resoluciones judiciales dictadas en esta materia, se han centrado en la negociación en el periodo de consultas, soslayando en cierto modo, la acreditación de las causas alegadas por el empresario en la decisión extintiva, especialmente cuando ha habido acuerdo en el periodo de consultas. En este sentido, cabría preguntarse si se han de corregir determinadas desviaciones que se han producido tras la desaparición de la autorización administrativa, pues el papel que debe cumplir en el periodo de consultas, a mi juicio, se ha desnaturalizado, al otorgar a este, un protagonismo relevante en la calificación de los despidos colectivos, infravalorando la concurrencia de la causa y sus consecuencias, y por ende, el enaltecimiento del cumplimiento de los requisitos formales como eje central del control judicial de los despidos colectivos, siendo el papel de la autoridad laboral en el procedimiento de despido colectivo, meramente instrumental.
Este trabajo ha sido finalista en el Premio Estudios Financieros 2016 en la modalidad de Trabajo y Seguridad Social. Una de las instituciones claves en todo sistema de relaciones laborales es, sin lugar a dudas, la extinción del contrato de trabajo. Y el despido colectivo por causas económicas, técnicas, organizativas o de producción constituye uno de los mecanismos de extinción más importantes y complejos de la regulación del Derecho del Trabajo, tanto desde la perspectiva sustantiva como procesal. El papel autorizante de la autoridad laboral desapareció, salvo en los casos de fuerza mayor que se mantiene, y, como consecuencia de ello, la regulación procesal laboral ha tenido que ser adaptada, pues se han visto afectados determinados preceptos de la Ley Reguladora de la Jurisdicción Social, entre ellos los relativos a la impugnación del despido colectivo por causas económicas, técnicas, organizativas o de producción regulada en el artículo 124 de esta ley. La complejidad de esta nueva modalidad procesal hace indispensable abordar el estudio de la legitimación para impugnar un despido colectivo, siendo el objeto del presente trabajo realizar un análisis normativo de la legitimación para impugnar un despido colectivo. Asimismo, se estudiará el tratamiento de la legitimación pasiva, así como las principales dudas interpretativas que su aplicación genera.
La fuerza mayor provocada por la COVID-19 ha sido priorizada por el legislador como mecanismo de flexibilidad interna frente a la extinción de los contratos de trabajo, al igual que ha sucedido ahora con la guerra de Ucrania, y, por ende, la denominada prohibición de despedir. En este contexto, cobran especial relevancia aquellos supuestos de tránsito de un expediente de regulación temporal de empleo al despido, en los que la empresa presente pérdidas con anterioridad a la COVID-19, y ahora también, con anterioridad a la guerra de Ucrania. Por ello, se hace necesario realizar un análisis normativo y jurisprudencial de los preceptos que regulan la denominada prohibición de despedir, con la finalidad de determinar, si se establece o no, una “prohibición de despedir”, y si la misma vulnera la libertad de empresa, y cuál debería ser la calificación jurídica atribuida al despido; nulidad o improcedencia, así como su ámbito temporal, material, y subjetivo. Asimismo, se analizará, de manera sucinta, la calificación del despido sin causa justa, en relación con los textos internacionales y el control de convencionalidad tras la ratificación por España de la Carta Social Europea revisada.
La reforma del mercado de trabajo operada por la Ley 3/2012, de reformas urgentes para el mercado de trabajo, afectó al régimen jurídico procesal del despido colectivo, tanto en su vertiente colectiva como individual, modificando aspectos muy significativos, creando un panorama complejo, dotado de una cierta inseguridad jurídica en determinados aspectos, que ha provocado una regulación carente de la menor simetría. Una de las cuestiones que ha suscitado mayores controversias es la relativa a la comunicación de la decisión extintiva y su contenido, en cuanto a los criterios tenidos en cuenta en la selección de las personas trabajadoras afectadas por la medida extintiva y a la expresión de la causa motivadora del despido. Otro punto de inflexión lo constituyen los motivos de impugnación que los trabajadores pueden hacer valer para fundamentar su pretensión, pues algunos de ellos, como se verá, quedan supeditados a la acción colectiva produciendo efectos de indudable calado en las extinciones que se producen en el marco de un despido colectivo. Pues bien, el objeto de este estudio es analizar el tratamiento de la extinción del contrato de trabajo por causas objetivas cuando el mismo se produce en el marco de un despido colectivo, poniendo en relación el tratamiento de la regulación sustantiva con la procesal, es decir, el derecho sustantivo y el derecho adjetivo, siendo inconcebible que el mismo se regule mediante preceptos adjetivos, sin haberse modificado el precepto sustantivo que lo regula. Tampoco lo ha hecho la última reforma laboral aprobada por el Real Decreto-Ley 32/2021, de 28 de diciembre.
La Sentencia del TC NÚM. 61/2021 de 15 de marzo, objeto de este estudio, aborda la compleja cuestión sobre la consecuencia de la prueba ilícita obtenida con vulneración de derechos fundamentales y su repercusión en la calificación del despido. No obstante, de entrada, cabe destacar, que el TC puntualiza que no es objeto del recurso de amparo, ni le corresponde, decidir cuál de esas interpretaciones (improcedencia o nulidad), es la correcta, pues en tal caso se estaría efectuando un control de mera legalidad, rectificando la interpretación y aplicación de las normas legales realizadas por los Jueces y Tribunales en el ejercicio exclusivo de la potestad que les reconoce el artículo 117.3 CE, excediéndose del objeto propio de amparo, que es determinar si en ese ejercicio se ha violado o no alguna garantía constitucional.
