Es un gusto presentar a la comunidad académica este nuevo libro de investigación que recoge los mejores trabajos de investigación discutidos en el tercer Congreso de Derecho Internacional, organizado anualmente por el Grupo de Investigación en Derecho Internacional de la Facultad de Jurisprudencia de la Universidad del Rosario y sus organizaciones aliadas. En esta obra participaron treinta y cuatro autores que realizaron veinticinco contribuciones sobre temas variados que giran alrededor de cinco grandes temas del derecho internacional (i. derecho internacional público, ii. derechos humanos, derecho internacional humanitario y medio ambiente, iii. conflicto armado interno y justicia transicional, iv. corrupción y derecho internacional, v. derecho internacional privado y económico), por lo que esta obra puede considerarse como un nuevo aporte al estudio de esta área del derecho que, a pesar de su juventud frente a otras áreas, tiene un desarrollo progresivo que conlleva a una constante evolución normativa y conceptual supremamente interesante y profunda. Las recientes publicaciones de esta área se han caracterizado porque en su portada aparece una fotografía de un tribunal internacional o un evento icónico en la historia del derecho internacional. Por ello, para este libro, se seleccionó una imagen memorable para el derecho internacional en América Latina: una fotografía en la que las mujeres son las protagonistas. Todas ellas son, o han sido, juezas de la Corte Interamericana de Derechos Humanos, quienes se reu¬nieron para el evento de conmemoración de los 40 años de la entrada en vigor de la Convención Americana y de la entrada en vigor de la Corte Interamericana de Derechos Humanos, en San José, Costa Rica, el 17 de julio de 2018, durante el 125 Período Ordinario de Sesiones de la Corte Interamericana de Derechos Humanos.
En los últimos años las reformas a la política migratoria europea se han caracterizado por su apertura hacia la inmigración y la movilidad. A contrario sensu, Estados Unidos ha optado por la creación de políticas migratorias que pugnan por la reducción de la migración y por la detención del reclutamiento de trabajadores foráneos.No obstante, el incremento de los flujos de inmigración hacia el continente europeo derivado de inestabilidad política, crisis de derechos humanos y una serie de situaciones de emergencia humanitaria que azotan a la región del África del norte, han conducido a un endurecimiento de las medidas de control, selectiva y represión en la política migratoria de los países de la Unión Europea. En Estados Unidos, las polémicas y severas iniciativas legislativas y leyes estatales antiinmigrantes que se han aprobado o discutido, han generado un ambiente de oposición, y un respaldo hacia la creación de políticas migratorias proinmigrantes.Este panorama actual denota un cambio en la orientación de la política migratoria europea y estadounidense, hacia una más restrictiva en el primer caso, y más liberal en el segundo.El presente artículo constituye un análisis preliminar sobre el cambio de perspectiva en materia de política migratoria que han sufrido Estados Unidos y Europa, motivado por los acontecimientos políticos y sociales que afectan a estas regiones en virtud de la crisis política y humanitaria africana en el caso europeo, y las reformas legislativas antiinmigrantes en el caso estadounidense, basándose principalmente en la recopilación de información periodística como fuente secundaria de investigación. El trabajo tiene como objetivo servir como punto de partida para el análisis de las actuales políticas públicas en materia de migración.
