Pensar diferentemente a Históriaoucault revoluciona a História. Com esta frase polêmica e instigante, Veyne chamou a atenção dos historiadores para um movimento conceitual em curso desde os anos sessenta e para o qual ainda não havíamos tido olhares muito favoráveis (cf. Veyne, 1982). Éramos, assim, atingidos por vários lados: de um lado, este historiador-filósofo questionava uma rápida apropriação daquilo que, em Foucault, podia servir diretamente à produção historiográfica recente, a exemplo do conceito de poder disciplinar, excelente para pensarem-se as formas da dominação no cotidiano da vida social; de outro, forçava-nos a refletir sobre a abrangência do pensamento daquele filósofo, pensamento que excedia em muito nossas desatentas miradas.Foi assim que, partindo de uma irrecusável apreciação de Vigiar e punir, trabalho histórico por excelência, publicado em 1976, caminhamos, nós historiadores, em busca da produção anterior de Foucault, em especial da História da loucura, de As palavras e as coisas e de A arqueologia do saber, O efeito-Foucault na historiografia brasileira MARGARETH RAGOProfessora do Departamento de História do IFCH-UNICAMP RESUMO: O artigo investiga as transformações nas concepções do que é história e, portanto, nas formas de estudá-la, após as proposições conceituais elaboradas por Foucault. A mudança do foco da análise dos fatos e eventos para as bases epistemológicas das formas de discurso que os conceberam enquanto tais, fará com que o historiador busque compreender os campos de relações de força nos quais se constituem os jogos de poder, e não mais se deter em uma suposta verdade documental.
In this text, I highlight the convergences of the feminist interpretations with Foucault's reflections regarding his criticism of the modes of subjection promoted in modernity and the search for other possibilities of existence. His analyzes of neoliberalism and his notion of counter-conduct are useful for thinking about the feminist politics of subjectivity, which fight against normalizing processes and affirm the desire for the truth about itself. These struggles demand the courage of truth, as evidenced by the forms of exclusion, torture and death used against them historically, from the bonfire and guillotine in the past to prisons in dictatorships and to other forms of daily violence. Although neoliberalism today appropriates various feminist agendas, valuing the competitive figure of the "self-entrepreneur", feminisms denounce these sophisticated technologies of power in their struggle for an anti-capitalist, philological and libertarian world.
Resumo: Nesse artigo, apresento duas interpretações divergentes em relação ao Direito e às políticas públicas, que se inspiram nas reflexões de Michel Foucault sobre o poder, a lógica punitiva e os direitos. A partir das análises de alguns especialistas sobre a filosofia de Foucault e sua noção de "contraconduta", estendo a discussão, num segundo momento, para problematizar os desafios enfrentados pelos feminismos em relação ao paradoxo dos direitos e às saídas oferecidas para conter a violência sexual e de gênero cometida contra os corpos femininos, seja no campo jurídico, como a Lei Maria da Penha e a tipificação do feminicídio, seja na dimensão ética, com o cuidado de si e as práticas de si. Foucault, feminisms and the paradox of rightsAbstract: In this article I focus on two diverging interpretations of the Law and the public policies, that are inspired by Michel Foucault´s reflexions on power, on the punitive logic and the rights. I follow the analysis of some experts on Foucault´s philosophy and on his notion of "counterconduct". Secondly, I extend this discussion to problematize the challenges faced by feminisms concerning the paradox of the rights and the issues offered to counter sexual and gender violence committed against female bodies in the legal field, such as the Maria da Penha Law and the typification of feminicide, and in the ethical dimension with the care of the self and the practices of the self. CONTRA A LÓGICA PUNITIVAEu tinha um segundo motivo para estudar a prisão: retomar o tema da genealogia da moral, mas seguindo o fio das transformações do que se poderiam chamar de 'tecnologias morais' . Para melhor compreender quem é punido e por que se pune, colocar a questão: como punimos? (FOUCAULT, 1994, p. 21).A luta pelos direitos no Brasil tem sido considerada quase que unanimemente como uma importante conquista dos movimentos sociais, desde o fim da última Ditadura militar, e foi acompanhada pela substituição da narrativa tradicional da esquerda em nome da "revolução" pelo discurso dos direitos humanos, desde o final dos anos setenta. O foco da "luta de classes", da exploração econômica do trabalho pela classe dominante deslocou-se para outros temas arrolados na denúncia do terrorismo estatal e das violações cometidas contra a integridade física e psíquica dos cidadãos.Para vários autores que passaram a refletir sobre o legalismo de esquerda e o legalismo liberal, trata-se, então, de uma "virada legal" -o chamado "legal turn" -, quando se inicia a "era dos direitos" (BROWN, 2002, p. 6).
