Resumo Inserido no campo da sociologia das elites, procura-se compreender como e por que a magistratura no Brasil reproduz em suas estruturas uma dinâmica aristocrática e elitista que parece ser incompatível com os discursos que compõem suas próprias justificativas teóricas e com os princípios democráticos que regem suas funções. Os magistrados se estabelecem como um grupo especial que reserva para si um espaço sociopolítico exclusivo por meio de uma série de características e disposições que compõe seu habitus específico, o que produz reflexos no campo jurídico em que atuam. A magistratura distingue-se das outras carreiras do funcionalismo público e, radicalmente, da maioria da população. Para compreender esse cenário, este artigo propõe um exame das contradições presentes na estruturação do Judiciário, notadamente, na permanência de privilégios adquiridos em âmbito histórico, em seu modelo de recrutamento e progressão e nos altos salários pagos aos magistrados brasileiros. Considerando essas distorções, conclui-se que o compartilhamento de espaços de socialização exclusivos entre a elite jurídica e as elites política e econômica distancia-os drasticamente da população e influi de modo decisivo na produção de uma prática judicial que tende a conservar as relações de poder como estabelecidas.
Resumo O artigo propõe um mapeamento dos feminismos e das posicionalidades queer, demonstrando como o gênero e a sexualidade se apresentam como categorias úteis de análise e crítica do direito. Ele reconstitui algumas das principais discussões e dilemas das lutas e das teorias feministas e queer a fim de identificar como as suas categorias, métodos e estratégias oferecem uma posição privilegiada e potente para a crítica jurídica.
Resumo: A intensificação das interações a nível mundial conferiu ao Direito Comparado um novo destaque e relevância, do qual emergem diversos questionamentos, principalmente acerca de quais as formas de empreender um estudo comparado de forma consistente e segura. O presente trabalho busca sistematizar, de modo didático, diferentes métodos do Direito Comparado, evidenciando suas técnicas, suas vantagens e seus perigos. Dessa forma, pretende-se auxiliar estudantes e pesquisadores interessados na pesquisa comparada, chamando atenção para os cuidados a serem tomados para que se evitem problemas na comparação. Foram analisados os métodos funcionalista, estruturalista e hermenêutico, apontando as hipóteses em que cada um desses pode ser melhor empregado. O Direito Comparado pode ser um instrumento profícuo de reflexão sobre o direito do outro e sobre o próprio ordenamento, além de permitir o aprimoramento das instituições e institutos, desde que observados cuidados imprescindíveis para assegurar sua coerência. O estudo de cada um desses métodos permite ao comparatista melhor compreender sua própria análise e evitar problemas que comumente se identificam na aplicação desses métodos. Por fim, a título conclusivo, aponta-se que a adoção de um pluralismo metodológico e de um comparativismo crítico, que conjuguem as principais vantagens de cada método para a análise a ser realizada, pode fornecer a melhor opção àquele que pretende enveredas pelos caminhos da comparação jurídica.
