Zusammenfassung: Ziel der Arbeit war es, die Art und Häufigkeit von vorgeworfenen tierärztlichen Diagnose-und Befunderhebungsfehlern bei der Hufrehe darzustellen und deren Beurteilung durch sachverständige Gutachter zu untersuchen. Zu diesem Zweck wurden 22 Gutachten, die sich mit dem Vorwurf des tierärztlichen Fehlers bei der Diagnostik der Hufrehe befassen, deskriptiv statistisch ausgewertet. Die Gutachten stammen aus den privaten Archiven von 4 Gutachtern, die langjährige Erfahrung auf dem Gebiet der Pferdeorthopädie besitzen. Am häufigsten wurde dem Tierarzt das Nichterkennen bzw. die Fehlinterpretation von klinischen (36,4 %) und röntgenologischen (36,4 %) Befunden vorgeworfen. Weitere Kritikpunkte waren unterlassene klinische (9,1 %), röntgenologische (13,6 %) und weiterführende diagnostische (4,5 %) Untersuchungen. In 13 von 22 Fällen (59,1 %) erwiesen sich die Vorwürfe der Patientenbesitzer gegen den Tierarzt gemäß der Beurteilung der Gutachter als nicht gerechtfertigt. In 9 Fällen (40,9 %) bestätigten die Gutachter den Vorwurf des Diagnoseund/oder Befunderhebungsfehlers. In jeweils 3 Fällen beanstandeten die Gutachter die Fehlinterpretation von klinischen (33,3 %) und rönt-genologischen (33,3 %) Befunden, in 2 Fällen (22,2 %) eine unterlassene klinische Untersuchung und in 1 Fall (11,1 %) eine unterlassene röntgenologische Untersuchung. Zur Vermeidung von Diagnose-und/oder Befunderhebungsfehlern bei der Hufrehe sind eine systematische klinische Untersuchung, eine standardisierte röntgenologische Untersuchung sowie die Kenntnis der unterschiedlichen Symptomatik in den einzelnen Krankheitsstadien der Hufrehe essentiell. Die differentialdiagnostische Abgrenzung der Hufrehe zu ähnlichen Krankheitsbildern wie dem der Pododermatitis kann im Anfangsstadium dennoch schwierig sein. Zusammenfassung: Schadenersatzforderungen gegen Tierärzte aufgrund von vermeintlichen Behandlungsfehlern verzeichnen seit den 70er Jahren einen ununterbrochenen Anstieg. Als Gründe dafür werden unter anderem die zum Teil schwierige Diagnostik und Therapie bestimmter Krankheiten aufgeführt. Die akute Hufrehe des Pferdes, als eine der bedeutendsten Pferdekrankheiten, kann unzweifelhaft dazu gezählt werden. Anhand von 30 Gutachten aus privaten Archiven von 4 Sachverständigen mit langjähriger Erfahrung auf dem Gebiet der Pferdeorthopädie wird die gutachterliche Beurteilung von Vorwürfen des tierärztlichen Behandlungsfehlers im Zusammenhang mit Hufrehe deskriptiv statistisch ausgewertet. Die Behandlungsfehler-Vorwürfe der Pferdebesitzer (n = 36) richteten sich in 55,6 % (n = 20) gegen die durchgeführte Hufrehe-Therapie des beschuldigten Tierarztes und in 44,4 % (n =16) gegen eine tierärztliche Behandlung, in deren Folge eine Hufrehe aufgetreten war. Die Gutachter bestätigten einen Behandlungsfehler bei der Hufrehe-Therapie in 55,0 % (n =11) und begrün-deten diesen in 54,5 % (n = 6) der Fälle mit vorangegangenen Diagnosefehlern und in 45,5 % (n = 5) der Fälle mit einer unzureichenden orthopädischen Therapie. Eine frühzeitige orthopädische Maßnahme, mit dem Ziel, die erkrankten Bereiche zu entlasten um eine weitere Schädigung des Hufbeinträgers zu verhindern und somit einer Dislokation des Hufbeins vorzubeugen, ist nach Meinung der Gutachter ein fundamentales Therapieprinzip für die akute Hufrehe. Als spezielles forensisches Problem stellte sich der Vorwurf "iatrogene Hufrehe" dar, wobei der Cortison induzierten Rehe mit 68,8 % (n =11) die größte Bedeutung zukam. Insgesamt bestätigten die Gutachter den Behandlungsfehler-Vorwurf "iatrogene Hufrehe" in 31,3 % (n = 5), weil in diesen Fällen ein ursächlicher Zusammenhang zu einer vorangegangen Cortisonbehandlung mindestens mit Wahrscheinlichkeit bestanden habe und eine Cortisongabe nicht indiziert war oder nicht gemäß den Anwendungshinweisen des Herstellers durchgeführt wurde.Schlüsselwörter: Hufrehe / Therapie / Behandlung / Behandlungsfehler / Gutachten / Schadenersatz / Haftpflicht / Gerichtliche Veterinärmedizin / Forensik Veterinary medical errors in the treatment of acute equine laminitis -Evaluation of 30 expert reportsDamage compensation claims against veterinarians on the grounds of alleged treatment errors have increased steadily since the 1970s.
