Até finais da década de 80, o desenvolvimento e os direitos humanos eram tratados como temas isolados, possuindo estratégias e objetivos distintos e divergentes. Passadas duas décadas, compreende-se que não há como dissociar os dois temas. Na atualidade, os direitos humanos são objeto de uma crescente promoção, especialmente com enfoque baseado no marco conceitual do desenvolvimento humano, o qual se baseia em normas internacionais e persegue o objetivo de fomentá-los e protegê-los. É neste contexto que se insere o direito ao acesso à água potável, o qual, após inúmeras tratativas, passou a ser compreendido como direito humano. O objetivo deste artigo é discutir a questão da água como direito humano, a partir da análise dos Fóruns Mundiais da Água que acontecem desde 1997 e envolve os setores público, privado, não governamental e científico. O método da pesquisa é qualitativo, baseado na análise textual qualitativa dos documentos destes eventos.
Resumo: A existência dos lixões já repreendida pela legislação brasileira desde 1981, e que em 1998 foram tipificados como crime ambiental, mas foi somente em 2010, com a Política Nacional de Resíduos Sólidos que foi regulamentada a destinação dos resíduos sólidos no país, bem como a concessão de prazo para a extinção dos lixões em 2014. A questão é que o prazo para o fim dos lixões não foi respeitado por 41,6% dos municípios brasileiros, entre eles o município de Iguatu-CE. Esta cidade além de permanecer com a destinação incorreta, abriu, em 25 janeiro de 2017, um segundo lixão, intitulado de lixão controlado, que segundo a prefeitura, os resíduos seriam despejados em uma vala já existente e em seguida seriam cobertos com terra para evitar o mau cheiro. A localização deste novo é mais distante da sede do município e das vias públicas de grande movimentação, em relação ao lixão da Chapadinha, demonstrando apenas a pretensão da solução estética e superficial do problema. Situação esta que durou 29 dias, pois no dia 27 de fevereiro, depois de diversas reportagens da mídia local, o Ministério Público emitiu um documento sugerindo que a prefeitura suspendesse o despejo de lixo no novo local e que apresentasse num prazo de 30 dias um plano de recuperação da área afetada. Além desta situação, a destinação incorreta de resíduos se configura como conflito nos mais diversos segmentos: ambiental, social, jurídico, territorial, econômico, sanitário e de saúde pública. A educação baseada na participação e que valoriza práticas culturais locais fundamenta a Política Nacional de Educação Ambiental (PNEA) e a prática educativa do sujeito ecológico. O objetivo deste artigo é identificar elementos que constituem o sujeito ecológico no Programa Cultivando Água Boa (CAB) por meio das práticas dos seus educadores ambientais. Utilizou-se a pesquisa bibliográfica para conceituar a Educação Ambiental, a pesquisa documental para caracterizar o CAB, bem como observações e entrevistas para identificar os elementos que compõem o perfil dos educadores ambientais do CAB. Os resultados apontam que a formação e a motivação para desenvolver ações de Educação Ambiental locais atravessam os modos de fazer destes atores que atuam no CAB.
Resumo: A imprescindibilidade da água para a manutenção da vida tem mobilizado a sociedade civil no sentido de se atribuir a tal bem a condição de direito humano. Neste sentido, o presente artigo apresenta a evolução normativa nacional e internacional que contribui para o reconhecimento da água como direito humano. O estudo decorre de uma pesquisa bibliográfica e documental que se debruça sobre as principais legislações e documentos elaborados pela sociedade civil referentes ao tema, envolvendo seu reconhecimento como direito humano e fundamental, destacando deliberações e Conferências da Organização das Nações Unidas (ONU); Constituição Federal de 1988 e Lei nº 9433/1997, que institui a Política Nacional de Recursos Hídricos e cria o Sistema Nacional de Gerenciamento de Recursos Hídricos, além de pesquisa bibliográfica em doutrina especializada. A análise realizada demonstrou que até o presente momento inexiste um documento formal que tenha sido ratificado por todos os países que reconheça a água como direito humano. A inexistência deste documento, no entanto, não é óbice para o reconhecimento tácito desta condição, o qual é extraído dos demais documentos investigados. Este reconhecimento, contudo, se revela insuficiente, devendo haver maior comprometimento para concretização do direito à água por meio de práticas perenes dos Estados e da participação da sociedade.Palavras-chave: Água.
