Black cabs and red buses are part of the London landscape. Countless tourists, bedazzled by the sight and using expensive Nikons, cheap disposable cameras or mobile phones, have been taking snapshots of a red bus passing the Houses of Parliament in Westminster, quite often because they had seen the scene before in some or other tourist brochure, all of them oblivious of copyright issues. There is reason to believe that the reaction of any sensible person on the Clapham bus would be that there cannot be any copyright in a photo of such a mundane scene and, in any event, unless one copies a photograph for instance by photocopying, one cannot infringe copyright. It is also unlikely that the poor tourist, turning around and photographing the statue of Mr Mandela on Parliament Square, would give a thought to the fact that he was infringing the copyright of the sculptor, at least under South African law. 1 A shot of General Smuts, though, will not cause any complication under our law, considering that the sculptor, Jacob Epstein, died in 1959 and that we have not yet succumbed to the life plus 70-regime. The example of the red bus in London instead of a minibus taxi (or for that matter, a black Mercedes-Benz with tinted windows and no number plates) passing the Union Buildings in Pretoria is chosen not because of affectation but because of the judgment in the England and Wales Patents County Court in Temple Island Collections Ltd v New English Teas Ltd, 2 which dealt with a photo of a red bus passing those particular Houses. By the way, there are sculptures of both General Smuts and Mr Mandela in front of the Union Buildings.
Die deutschen Neurologen sind mit dem Konzept der Stroke Unit als Einrichtung zur interdisziplinären Akut-und Erstbehandlung von Schlaganfallpatienten unter neurologischer Leitung und dem Konzept der Stroke Unit als zentraler Steuerungseinheit einer geschlossenen Versorgungskette für Schlaganfallpatienten mit dem hohen Anspruch angetreten, höhere Versorgungsqualität mit besserem Outcome zu noch günstigeren Preisen zu realisieren. Schon der Nachweis einer besseren Ergebnisqualität ist wegen der immer nur bei einem Teil der Patienten wirksamen Therapiemaûnahmen und heterogener externer Einflüsse nur schwer zu führen. Selbst in schon lange vor den Stroke Units etablierten Einrichtungen anderer Fachdisziplinen, wie den kardiologischen Herzinfarktstationen, ist bisher der Nachweis nicht gelungen, dass durch die inzwischen flächendeckende, qualitativ äuûerst hochstehende Akutversorgung der Herzinfarktpatienten die Gesamtletalität dieser Klientel signifikant gesenkt werden konnte oder dass dadurch gar die Lebenserwartung der Bevölkerung gestiegen ist. Dass die Kosten durch die modernen interventionellen kardiologischen Verfahren wesentlich höher sind als früher, ist hingegen unstrittig.Immerhin kann die Neurologie nach der vorliegenden Publikation für sich in Anspruch nehmen, dass sie für eine volksmedizinisch bedeutende, schwer wiegende Krankheit ihres Fachgebietes, den Schlaganfall, Anhaltszahlen der anfallenden Kosten liefern kann. Dieses Wissen stellt für die Arbeiten zur leistungsgerechten Gestaltung der DRGs (diagnosis related groups) eine wertvolle Vorarbeit dar. Demnach entfallen für die Behandlung eines Schlaganfallpatienten etwa 9000 DM Kosten auf die Leistungen der Akutkrankenhäuser und etwa 7000 DM auf Leistungen der Rehabilitationseinrichtungen.Die nähere Betrachtung des Zahlenmaterials der vorliegenden statistischen Analyse von insgesamt 5192 Schlaganfallpatienten, davon 3417 Schlaganfallpatienten aus Stroke Units, 1308 Patienten aus neurologischen Allgemeinstationen, jedoch nur 467 Pa-tienten aus internistischen Kliniken, macht allerdings erneut ernüchternd klar, wie schwer, ja geradezu unmöglich es ist, Daten aus selbst gut durchorganisierten Teilbereichen unseres Gesundheitssystems zu erhalten, die inhaltlich zuverlässig und repräsentativ sind. Die wesentlichen Ergebnisse der Studie stellen sich wie folgt dar:(1) Das Outcome nach Behandlung auf der Stroke Unit war signifikant besser, als das Outcome nach Behandlung auf einer internistischen Station, allerdings hatten die Internisten mit einem signifikant höheren Lebensalter der Patienten beim Eintritt in die Klinik und mit einer höheren Komorbidität ihrer Klientel zu kämpfen. Nach statistischer Korrektur für diese beiden Faktoren lieû sich kein statistisch signifikanter Unterschied zwischen den beiden Behandlungsformen mehr nachweisen. Das liegt an den zwangsläufig auûerordentlich breiten Konfidenzintervallen bei der Berechnung der Odds Ratio, die jede und damit keine Interpretation zulassen. As one of the founding fathers of the Afrikaans language, Rev SJ du Toit, wrote in 1891: language is a portrait of the soul and life of a nation;and it mirrors the character and intellectual development of a people (my translation).Unfortunately language tends to divide, more particularly, a multilingual society. Law is supposed to close the divide but more often than not widens it and is used to deepen divisions. This is because the ruler determines the law and, consequently, the language of the law, in the belief that the use of language can be enforced from above. Law and language, like oil and water, do not mix although the former is dependent on the latter.
