Au Brésil l’histoire des mondes du travail est indissociable de celle des acteurs qui ont fait commerce de la mise à disposition et de la mobilisation de la force de travail. Je me propose ici de remonter aux sources du système d’intermédiation de l’emploi brésilien contemporain qui se distingue dans le monde par l’usage de bureaux de placement payants pour les travailleurs. Dans ce but, l’article retrace le processus d’institutionnalisation du marché du placement des chômeurs qui, en 1972, a conduit le gouvernement autoritaire à dénoncer la convention n° 96 de l’Organisation internationale du travail (OIT) visant à l’extinction des bureaux de placement payants, texte pourtant ratifié par le pays en 1957. La régulation du commerce du placement est analysée au prisme des rapports entre l’élite gestionnaire des entreprises, l’administration du ministère du Travail et les organisations représentatives des intérêts des intermédiaires.
Résumé En accumulant des données sur deux dispositifs d’attribution des droits sociaux (aides aux jeunes et droits liés au handicap), nous examinons quel est le statut réservé au demandeur, puis les logiques bureaucratiques et morales qui président au tri des demandes par les acteurs des deux dispositifs. Nous nous interrogeons ensuite sur les marges de manœuvre effectives des usagers dans la co?construction de la demande ainsi que sur les façons dont s’élabore la connaissance des besoins auxquels il s’agit de répondre. Cette comparaison montre qu’il n’y a pas une, mais des « magistratures sociales », plus ou moins participatives, plus ou moins conditionnelles et discrétionnaires, selon le type de bénéficiaires.
L’article se propose d’expliciter, à partir d’une enquête sur le principal dispositif d’assistance-chômage pour les jeunes Français (le Fonds d’aide aux jeunes), certains facteurs organisationnels et professionnels du non-accès des jeunes à l’aide sociale. Une partie de la non-connaissance, de la non-réception et finalement de la non-demande de droits et de services par les jeunes découle en effet de la mise en oeuvre pratique d’une économie morale de l’accompagnement : la stratégie de défense de la dignité professionnelle des conseillers en missions locales, d’une part, et les normes de solidarité publique, d’autre part, conduisent à privilégier, dans l’accès à l’offre d’aide sociale, les jeunes construisant une relation pacifiée et de long terme avec les professionnels. L’existence d’une relation d’accompagnement apparaît alors comme une condition de proposition et d’octroi de l’aide financière.The aim of this paper is to make explicit certain organizational and professional factors that have the effect of disqualifying young people from social assistance, based on an investigation of the main unemployment relief program for French youth : the Fonds d’Aide aux Jeunes. Part of the reason why young people in France are not aware of, do not benefit from and do not assert their rights to services is the way a moral economy of support and guidance is implemented in practice : the strategy of defending the professional dignity of local youth counsellors, on the one hand, and the norms of public solidarity, on the other, mean that in facilitating access to social assistance, preference is given to youths who build peaceful, long-term relationships with professionals. The existence of a support and guidance relationship thus appears to be a prerequisite for the offering and awarding of financial assistance
