RESUMEN: Este artículo tiene el propósito de abordar la integración supranacional en América del Sur desde la perspectiva de la internacionalización del derecho constitucional. Para ello, en la primera parte propone una clasificación básica para entender las cláusulas de integración supranacional; cómo son y para qué sirven. En segundo lugar, aplica la clasificación planteada y ofrece una compilación analítica de las (doce) constituciones vigentes en la región. En esta investigación se expone un ejemplo de diálogo judicial y transformador entre la Corte Interamericana de Derechos Humanos y la Corte Constitucional de Colombia. En la medida en que estos dos tribunales se han tomado en serio los derechos a la consulta previa, libre e informada de los pueblos indígenas y afrodescendientes, se presentan detalladas tablas con los casos y las estadísticas producidas durante 25 años sobre el tema. La investigación se centra en el histórico precedente de la Corte Interamericana Saramaka v. Suriname (2007) y la sentencia T-129 de 2011 de la Corte Constitucional de Colombia por medio de la cual se profundizó el diálogo judicial y de donde quizá ha surgido el estándar de protección más plausible y equilibrado en la materia, aunque en riesgo de ser modificado regresivamente. De ahí que se puntualice la relevancia del “consentimiento vinculante” como alternativa al mal denominado “poder de veto”.
Desde los primeros intentos por descolonizar Latinoamérica se ha planteado la necesidad de un proceso de integración supranacional. Dicha demanda integradora desde hace algunas décadas ha tenido acogida constitucional en buena parte de las cartas políticas de la región. La Constitución colombiana (1991) contempla un excelente ejemplo de lo que se ha denominado “cláusula de integración latinoamericana”. Sobre la base de estos presupuestos, el presente artículo ofrece un análisis de la línea jurisprudencial de uno de los tribunales constitucionales más respetados de lo que se ha venido denominando “Sur global”.
