Resumo O objetivo deste estudo é analisar a relação existente entre a lógica da colonialidade, os discursos de desumanização que graduam os seres humanos em diferentes escalas de valor e a violação seletiva de direitos humanos por meio da discriminação. O estudo é resultado de investigações de cunho exploratório realizadas por meio de revisão bibliográfica teoricamente orientadas pelo referencial descolonial. Pretende investigar de que forma a violação de direitos humanos é seletiva e como o Direito Internacional dos Direitos Humanos atua em face da discriminação contra aqueles a quem se nega o pleno status de ser humano. Com base nisso, seu principal resultado consiste em afirmar que a proteção efetiva dos direitos humanos está ligada à condição daqueles sujeitos nos quais o discurso racional-individualista identifica os traços do humano enquanto a sua violação está ligada aos processos de discriminação sofridos por aqueles que não são percebidos como integralmente humanos. Este processo de privação de direitos resulta de uma lógica de colonialidade moderna e global que consiste na dominação por meio de discursos desumanizantes.Palavras-chave: direitos humanos; colonialidade; discriminação INTRODUÇÃO Este artigo pretende problematizar a seguinte questão: existe uma relação entre (1) a depreciação de certos seres humanos que não são considerados plenamente humanos, (2) a violação seletiva de direitos humanos por meio da discriminação e (3) a lógica da colonialidade, que propõe algumas explicações para a ligação entre os dois fenômenos anteriores.O Direito Internacional dos Direitos Humanos têm se expressado por meio de um corpo normativo que objetiva reverter os processos históricos de privação e de ofensa à dignidade da maioria dos seres humanos, reforçados por um discurso de relativização da sua humanidade que torna natural uma diferença hierárquica entre seres da mesma espécie. A inferioridade dos negros, índios, mulheres, homossexuais, não-cristãos e outros tem sido determinada por um discurso de gradação e hierarquia da humanidade, que sobrevive até hoje. A fim de justificar que alguns seres humanos não têm direitos e, portanto, podem ser discriminados foi anteriormente
Como citar este artigo / How to cite this article (informe a data atual de acesso / inform the current date of access): RESUMOO discurso universalista dos direitos humanos, construído sobre o paradigma liberal-individualista da modernidade, apresenta limitações no que se refere ao reconhecimento e à concepção positiva da humanidade de determinados grupos historicamente inferiorizados, que são alvo de preconceito, de discriminação e de exclusão. O objetivo deste trabalho é apontar a perspectiva da interculturalidade como possibilidade para a construção de uma visão de direitos humanos que parta da realidade sociohistórica de América Latina, caracterizada pela pluralidade de culturas, mas que, todavia, tem menosprezado certos indivíduos e grupos (negros, indígenas, mulheres e homossexuais). Para tal apontamento, faz-se uma análise bibliográfica das bases ideológicas do discurso dominante (ocidental) dos direitos humanos, expondo as insuficiências do multiculturalismo e propondo a interculturalidade. Os resultados finais apontam que a interculturalidade é a saída mais adequada para a efetivação dos direitos humanos na América Latina, pois abarca as realidades plurais que se apresentam na região e enfrenta a lógica hierarquizadora imposta pelo projeto moderno/colonial, elemento que não é enfrentado pelo multiculturalismo. 2 ResumoEste artigo analisa o discurso de fundamentação, na ADPF 186/DF, acerca dos direitos das minorias negras. A Análise Crítica do Discurso Jurídico (ACDJ), com ênfase nos efeitos ideológicos e políticos do discurso, revela, no corpus desta análise, indícios das matrizes teóricas pós-colonial e descolonial dos direitos humanos. Assim, como resultado, desaloja-se aquilo que se oculta ideologicamente no plano do posto, do pressuposto, do implícito ou do subentendido nessa decisão do STF. A partir daí, construímos um roteiro de indicadores, no discurso, do giro descolonial, com os seguintes conceitos-chave, a saber: alteridade, exterioridade, interculturalidade, pluriversalidade e empoderamento. Resumo: A fundamentação dos direitos humanos é uma tarefa própria do campo de investigação filosófica que pretende, de um lado, refletir sobre a razão da existência desses direitos e, de outro, estabelecer os argumentos que lhe conferem validade e legitimidade. Neste trabalho não se pretende responder diretamente às questões de existência e legitimidade dos direitos humanos. Os objetivos são, de um lado, demonstrar que a fundamentação é condição para a efetividade dos direitos humanos e, de outro, que existe um discurso convencional de fundamentação, filiado a pressupostos teóricos de matriz racional-individualista, que é, ao mesmo tempo, dominante e incongruente porque restringe as possibilidades de proteção universal desses direitos. Dominante porque a ele se filia grande parte dos jusfilósofos do Ocidente, entre eles o próprio Norberto Bobbio, os quais produzem a mais vasta e influente literatura sobre o tema. Incongruente porque o conceito de humanidade proposto pelo marco racional-individualista falha ao justificar a pretensa universalidade dos direitos humanos. A apropriação da noção de interculturalidade, por outro lado, pode constituir o ponto de partida para a construção de discursos de fundamentação que estejam atentos a realidades culturalmente plurais.
