Trata-se de pesquisa qualitativa, bibliográfica e empírica que tem como objetivo estudar a aplicação da analogia in bonam partem nos casos em que há de se determinar a porcentagem da pena a ser cumprida à progressão de regime, após a vigência do Pacote Anticrime, por condenados em mais de um crime, sendo ao menos um deles cometido com violência à pessoa ou grave ameaça. O trabalho parte do exposto em outras pesquisas e jurisprudências sobre como a Lei nº 13.964 de 24 de dezembro de 2019, popularmente conhecida como "Pacote Anticrime", ao modificar o artigo 112 da Lei de Execução Penal (LEP), possibilitou uma multiplicidade de interpretações a respeito de qual o lapso temporal a ser adotado aos condenados que não são reincidentes específicos em crimes hediondos ou equiparados, assim como em crimes cometidos com violência à pessoa ou grave ameaça. Nesse cenário de ambiguidades, a pesquisa concluiu pela aplicabilidade da analogia in bonam partem, de modo a se adotar uma interpretação não especificada no texto legal de dividir os lapsos temporais à progressão de regime entre os crimes comuns e os cometidos com violência e grave ameaça, considerando a existência de reincidência específica para essa espécie de crime. Alcançou-se o entendimento de ser a proposta de resolução mais adequada aos princípios constitucionais e de Direito Penal vigentes, e de que as teses aplicadas pelos tribunais superiores aos reincidentes não específicos em crimes hediondos podem ser aplicadas extensivamente aos reincidentes não específicos em crimes com violência ou grave ameaça.
