The Brazilian Constitutional definition of health as a social right makes the State the guarantor of this legally protected interest. The federalist system adopted in the 1988 Brazilian Federal Constitution determines that the Federal Government, states, and municipalities share the authority to care for health and the concurrent authority to legislate on health matters. This shared authority is based especially on the model of decentralization of public actions and services in health and the regional disparities across Brazil's territory. As Brazil has confronted the COVID-19 pandemic, this heterogeneity has intensified, allowing the Federative Units to adopt different measures that limit rights and public freedoms, depending on the pandemic's progression in the respective geographic area. The range of autonomy for these government entities was recently reaffirmed by the Brazilian Supreme Court (STF) with its ruling on Direct Unconstitutionality Suit n. 6,341/2020 1. The Supreme Court's ruling reinforced the role of local health authorities and public administrators in the adoption of legislative and administrative measures against COVID-19. Each branch of government in Brazil performs its respective role. Since the COVID-19 public health emergency of national concern was declared by the Ministry of Health 2 , extensive legislation has been produced by the Federal Executive and Legislative Branches (Portal da Legislação. Legislação COVID-19. http://www4.planalto.gov.br/legislacao/portal-legis/legislacao-covid-19, accessed on 16/May/2020), not only in health, but also including economic and tax issues, social security, services provision, and individual rights and guarantees, among others. States and municipalities have also contributed to the creation of a new legal framework. The clash between fundamental rights, the exercise of public freedoms, and respect for restrictive rules and confinement, with the aim of drawing limits between the development of administrative rules, jurisprudence on the protection of (and guaranteed access to) health, and the possibility of exercising individual autonomy have been the object of analysis by the Brazilian academic community 3. This scenario provides the backdrop for the first declaration of a lockdown in Brazil, in the cities of São Luís, São José de Ribamar, Paço do Lumiar, and Raposa, all located in the state of Maranhão, under a court order issued on April 30, 2020. The order responded to a claim filed by the local Public Prosecutor, based on the following factors 4 : total occupation of ICU beds dedicated exclusively to COVID-19 in the state public healthcare network; lack of transparency of this same information in the public networks in the above-mentioned cities; provision for lockdown in the Ministry of Health's
A doença falciforme é a afecção genética mais prevalente no Brasil; de acordo com o Programa Nacional de Triagem Neonatal (PNTN), nascem cerca de 3.500 (três mil e quinhentas) crianças por ano com hemoglobina S, uma das responsáveis pela doença, ou seja, 1/1.000 nascidos vivos no Brasil. Considerando o grau de sua incidência, é necessário observar o acesso à saúde possibilitado aos portadores dessa enfermidade, devendose analisar as difiuldades que aflgem esse segmento populacional e a efetividade das políticas públicas existentes para enfrentamento dessa hemoglobinopatia. Por meio de metodologia descritiva e explicativa, constatou-se que o segmento social acometido por essa doença se encontra historicamente associado aos afrodescendentes, dada sua origem mutante no continente africano em resposta à disseminação da malária, fato que conjuga a enfermidade com os fatores raciais de discriminação histórica da população negra. A falciforme foi utilizada, em certos casos, como fundamento para exclusão dos negros da sociedade, como argumento para segregação racial nos Estados Unidos e como fundamento para ideia de embranquecimento da população brasileira.
O presente artigo objetiva analisar a construção do ordenamento jurídico da saúde presente na Constituição Federal brasileira de 1988, bem como as alterações constitucionais ocorridas após sua promulgação. Para tanto, será traçado um histórico do sistema normativo de saúde no Brasil desde a sua independência em 1822 até a redemocratização pós-ditadura militar e as emendas constitucionais sofridas pela Constituição Cidadã. Com relação à metodologia empregada, o presente artigo adotou a revisão sistemática. Concluiu-se que, apesar dos inegáveis avanços na garantia do direito à saúde no Brasil, o financiamento do Sistema Único de Saúde permanece sendo negligenciado, o que compromete a prestação das ações públicas de saúde.
Objetivo: realizar uma revisão sistemática de estudos acerca da violência obstétrica, refletindo sobre o direito da parturiente ao acompanhante enquanto meio de prevenção da incolumidade de sua saúde física e psicológica. Metodologia: levantamento bibliográfico de artigos obtidos em diferentes bancos de dados e indexadores, publicados na íntegra em português e acessados de forma gratuita no período de agosto de 2019 a julho de 2020. Foram selecionadas revistas científicas na área do Direito Sanitário e da Saúde Coletiva, com extratos A e B no Qualis/Capes. Utilizou-se, ainda, dados constantes em documentos oficiais disponibilizados nos sites do Ministério da Saúde brasileiro, da Fundação Perseu Abramo e da Organização Mundial de Saúde. Resultados: verificou-se que a violação ao direito das mulheres grávidas no momento do parto pode ser considerada como uma espécie de violência, pois perdem a autonomia sobre o seu corpo, e que a garantia do direito ao acompanhante pode diminuir a incidência desse tratamento. Conclusão: essa violência fica evidente em diversas ocasiões, como na atenção mecanizada e técnica por parte dos profissionais de saúde e, pela presente pesquisa, nota-se que, em parte, esse tratamento ocorre na ausência de acompanhamento da gestante por uma pessoa de sua confiança, razão pela qual é possível afirmar que o cumprimento efetivo de leis que protegem o direito do acompanhante pode reduzir significamente os casos de violência obstétrica.
Manganese (Mn) is an essential microelement, but overaccumulation is harmful to many plant species. Most plants have similar minimal Mn requirements, but the tolerance to elevated Mn varies considerably. Mobilization of phosphate (P) by plant roots leads to increased Mn uptake, and shoot Mn levels have been reported to serve as an indicator for P mobilization efficiency in the presence of P deficiency. White lupin (Lupinus albus L.) mobilizes P and Mn with outstanding efficiency due to the formation of determinate cluster roots that release carboxylates. The high Mn tolerance of L. albus goes along with shoot Mn accumulation, but the molecular basis of this detoxification mechanism has been unknown. In this study, we identify LaMTP8.1 as the transporter mediating vacuolar sequestration of Mn in the shoot of white lupin. The function of Mn transport was demonstrated by yeast complementation analysis, in which LaMTP8.1 detoxified Mn in pmr1∆ mutant cells upon elevated Mn supply. In addition, LaMTP8.1 also functioned as an iron (Fe) transporter in yeast assays. The expression of LaMTP8.1 was particularly high in old leaves under high Mn stress. However, low P availability per se did not result in transcriptional upregulation of LaMTP8.1. Moreover, LaMTP8.1 expression was strongly upregulated under Fe deficiency, where it was accompanied by Mn accumulation, indicating a role in the interaction of these micronutrients in L. albus. In conclusion, the tonoplast‐localized Mn transporter LaMTP8.1 mediates Mn detoxification in leaf vacuoles, providing a mechanistic explanation for the high Mn accumulation and Mn tolerance in this species.
