Resumo O presente artigo realiza, por meio de dados documentais e de análise de discurso, a crítica dos votos dos Ministros do STF nas ações de controle de constitucionalidade sobre direitos homossexuais, tendo por hipótese que dada a tradição liberal do nosso sistema jurídico, as pautas de direitos homossexuais são absorvidas pela hegemonia liberal, colonizando e domesticando os discursos críticos e anulando as divergências e a pluralidade das pautas homossexuais.
Resumo: O presente artigo tem por objetivo mostrar como é possível, por meio da teoria procedimental do direito, ter um processo discursivo que, conseqüentemente, melhore o acesso à justiça no tocante ao direito processual civil brasileiro. Com isto, será possível superar a tensão que ocorre entre a necessidade de satisfação da pretensão e legitimidade dessa satisfação, ou seja, o correto provimento jurisdicional. Para tal intento, alguns institutos do direito processual civil brasileiro serão criticados e analisados sob o viés da teoria de habermas.Palavras-chave: Acesso à justiça. Processo civil. Teoria procedimental do direito.Abstract: By using the theory of legal procedure, the present article aims to show how it is possible to obtain a discursive process which, consequently, improves access to justice regarding the Brazilian civil procedure law. Thus, it will be possible to overcome the existing tension between the necessity of satisfaction of the claim and the legitimacy of such satisfaction, that is, the correct jurisdictional provision. In order to do that, some elements of the Brazilian civil procedure law will be criticized and analyzed from the perspective of the theory conceived by Habermas.
O presente trabalho apresenta a discussão sobre os conceitos de esfera pública e democracia, que permeia a teoria crítica, para a compreensão das instituições públicas de tomadas de decisão e das universidades como espaços públicos. Para tanto, recorre-se a revisão bibliográfica desses termos a partir das formulações teóricas de Jürgen Habermas, Nancy Fraser e Seyla Benhabib. Essas duas autoras são frequentemente associadas às teorias feministas deliberativas, haja vista que criticam e buscam reconstruir as noções da teoria social e da teoria crítica a partir de uma perspectiva de gênero. Como resultado, aponta-se que as instituições públicas de tomadas de decisão e as universidades, a partir da inclusão de públicos heterogêneos e de temas afetos às questões de gênero, raça e sexualidade, podem se constituir como espaços públicos de transformação e emancipação social.
