El texto reconstruye conceptualmente las distintas posturas académicas sobre la naturaleza de la laicidad del Estado colombiano, las cuales fueron recogidas en las cuatro tesis más relevantes sobre el tema. La primera de ellas sigue la línea jurisprudencial desarrollada por la Corte Constitucional que concibe a Colombia como un Estado laico. La segunda concibe el Estado como aconfesional y con cierta laicidad positiva que ampara y promueve las diversas manifestaciones religiosas, sin decantarse constitucional o legalmente por una confesión específica. Una tercera postura argumenta que Colombia no es un verdadero Estado laico, sino un Estado pluriconfesional con libertad religiosa, por cuanto las autoridades no han desarrollado plenamente los principios de neutralidad y separación, definitorios de la laicidad. Finalmente, la cuarta tesis plantea que el Estado colombiano no es laico sino teísta ilustrado, en la medida en que acepta e invoca la existencia de un dios basado en la razón ilustrada, del cual emana el poder público. La reconstrucción conceptual realizada está orientada a evidenciar cómo, desde la Constitución Política de 1991, se ha desarrollado un conflicto doctrinal sobre este tema, producto de un conflicto social de gran complejidad que es necesario reconocer.
