Este artigo aborda o impacto jurídico e social da internalização, no Direito Brasileiro, da Convenção sobre os Direitos das Pessoas com Deficiência (CDPD, 2008) e sua regulamentação - por meio da Lei Brasileira de Inclusão das Pessoas com Deficiência (LBI). O foco da análise será o reconhecimento da capacidade e da efetividade dos direitos humanos das pessoas com deficiência e seus reflexos nos institutos jurídicos da curatela e da interdição civil. Para tal, realizou-se pesquisa bibliográfica e documental e, a partir da teoria de justiça social, pautada pelas capacidades, de Martha C. Nussbaum, e da crítica dos direitos humanos, de Joaquín Herrera Flores, buscou-se verificar se os Tribunais de Justiça brasileiros têm aplicado a CDPD, pois, em tese, quanto maior a adesão à Convenção, maior o reconhecimento da autonomia e da capacidade das pessoas com deficiência; e, logo, menor o número de processos judiciais de interdição civil. Os resultados obtidos, por meio da análise dos dados do Tribunal de Justiça de Minas Gerais, relativos aos anos de 2010 a 2014, contudo, indicam outra direção.
