Entre as diversas alterações processuais penais efetivadas pela Lei 13.964/2019 está a introdução do Acordo de Não Persecução Penal, inserido no artigo 28-A do Código de Processo Penal. Este foi previsto como um instrumento para garantir a maior eficiência da justiça penal brasileira, visando ao desafogamento das varas criminais e ministérios públicos para permitir uma maior atenção à investigação e resolução de casos envolvendo criminalidade organizada e crimes graves. Embora a lei o descreva como um acordo entre o investigado e o órgão de acusação, a previsão de reparação do dano à vítima abre espaço para a discussão sobre a participação do ofendido nas negociações. O presente trabalho objetiva investigar de lege lata, por meio de metodologia de revisão bibliográfica, se tal participação é possível e, em caso positivo, qual seria sua extensão. Para isso, serão analisados tanto os aspectos que podem ser extraídos da leitura do artigo, quanto aqueles relacionados à própria razão de ser do direito processual penal, perpassando também a tendência moderna de revalorização do papel do ofendido nesse âmbito.
