Law no. 38/1999 on zakat administration was able to be successfully enacted not solely because the roots of democracy had began to grow in the country; but also because this law is based on the rationale purpose of zakat, that is, to help the poor. In this article, furthermore, the state is responsible to protect and provide necessary support for the poor and needy citizens, even though in fact, the state fails to do so, This is of course of great relevance considering the main aim of zakat is to improve the social and economic position of the poor.DOI: 10.15408/sdi.v13i3.556
This article examines the “bureaucratization” of Sharia in Indonesia, giving special attention to zakat, waqf and other aspects of family law. The bureaucratization of Sharia aims to modernize the legal system for Muslims in order to provide certainty and justice in solving legal disputes. While some scholars view the incorporation of Sharia into state law as an attempt at Islamization, this study argues that this process reflects increasing bureaucratization rather than Islamization. The incorporation of Sharia into state law is a project of formalizing a state-defined brand of Islam and Sharia legislation. This phenomenon has precedence in premodern Muslim governance and can be traced from the colonial period. In contemporary Indonesia, the Ministry of Religious Affairs and religious courts have played a central role in bureaucratizing Sharia. To support the argument, this study will explore Indonesian family law, including zakat and waqf.
is essay examines the transformation of charity administration operated by zakat agencies in Indonesia with special reference to Dompet Dhu'afa. is study offers an approach of marketing Islam in elaborating on zakat organizations that exercise community development through economic, social and humanitarian aid for disadvantaged people. e practice of zakat administration is basically designed to develop community-based programs among the poor and not struggle for Islamization or the politicization of Islam. Marketing zakat agencies does not attempt to commercialize religion; rather it is committed to the objective advancement about the effectiveness of religious teachings in Muslim communities. Marketing zakat to the public tries to demonstrate its role as the vanguard of social justice especially for the bene t of the destitute and needy. e proliferation of statesponsored zakat agencies (BAZNAS) vis-à-vis community-based zakat organization (LAZ) is not a case of state-initiated Islamization. It is rather an attempt at regulating public affairs, including zakat funds, within the state administration.
Proses pembentukkan Undang-undang Jaminan Produk Halal telah melalui proses yang panjang. Berbagai kelompok terlibat dalam pembentukan ini, baik dari unsur pemerintah, legislatif dan masyarakat sipil. Perdebatan di dalam dan luar legaslatif tentang substansi hukum ini memperlihatkan adanya perhatian dan kepentingan berbagai pihak. Perebutan pengaruh ini bukan saja antara pihak penguasa yaitu antara DPR dan Pemerintah, namun juga masyarakat sipil (civil society) yang dalam kasus ini adalah MUI dan kelompok organisasi masyarakat lainnya. Keterlibatan langsung mereka dalam proses pembentukan UU ini baik dalam forum resmi dan tidak resmi menunjukkan adanya negosiasi dan partisipasi penting dalam pembentukan UU. Ini menunjukkan bahwa masalah sertifikasi produk halal bukan masalah agama semata, atau kepentingan konsumen, tetapi juga kepentingan ekonomi. Ada tiga isu penting yang mengemuka ketika proses pengesahan UU ini berlangsung. Pertama, isu ekonomi menjadi alasan bagaimana masalah sertifikasi ini. Kedua, sensitifitas agama juga menjadi perhatian, yang dianggap lebih mementingkan umat Islam. Ketiga, politik kepentingan para fihak yang terlibat dalam pengelolaan dalam hal ini kementrian agama (pemerintah) dan masyarakat sipil (MUI).(The process of formation of Insurance Act Halal products has gone through a long process. The various groups involved in this formation, both from the government, legislature and civil society. The debate inside and outside legislative about this legal substance showed their concerns and interests of all parties. It is not only a struggle for influence between the authorities, namely between the Parliament and the Government but also the civil society which in this case is the MUI and other civil society groups. Their direct involvement in the process of establishing this law both in formal and informal forums show their negotiation and participation are important in the formation of the Act. This shows that the problem of certification of halal products is not religious issues per se, or the interests of consumers, but also economic interests. There are three important issues which arise when the process of ratification of this law took place. First, the economic issue is the reason how this certification issue. Second, religious sensitivity is also a concern, which is considered to be more concerned with Muslims. Third, the political interests of the parties involved in the management of religious in this ministry (government) and civil society (MUI))
This article discusses the role of Muslim middle class in making democratization in Indonesia. The democratization in Indonesia. The democratization in Indonesia has much indebted to the young Muslim’s contribution. This is started their efforts to enhance the sectors of economy, social, and education. Both social and educational sectors had become two main strategies to cultivate the democratization process. Surprisingly, the process of democratization had not happened within political parties, but in palces such as campuses and Islamic religious circles.
