The objective of the article is to identify, describe, and explain the grounds and conditions for realizing the right of rebellion, delimitation of the relevant democratic procedures from anti-state crimes. The main results of the research are that we have established the liberal and democratic principles for the realization of the right of rebellion. It has been established that it can be realized only on the grounds of the extreme necessity in restoring the rule of law, that is, while having an exclusively criminal and preventive purpose. We have also discovered that both a democratic procedure of realizing the right of rebellion can be solely considered on condition of sufficient justification, proof of the long ineffectiveness of other means of influencing the criminalized apparatus of the state, in particular judicial ones. It has been substantiated that the essential condition for the realization of such a right is the critical level of nonconfidence to the personnel of the highest agencies of state power in the overwhelming majority of the population, as well as the actual impossibility to apply (implement) the statutory forms of influence on their personnel. It is mandatory to consider the requirement of ensuring national security on the basis of a scientifically grounded criminological forecast of the deployment of mass resistance, taking into account the probable reaction to it by the subjects of international law. Thus, the realization of the right of rebellion should be non-violent. In all other cases, there is a criminal seizure of state power. The applied value of the research is the fact that due to the developed system of grounds and conditions for realizing the right of rebellion, the latter, as it is, may be delimitated from political criminal practices aimed at dismantlement of the Constitutional statehood, the seizure of state power. The results of the research may also be taken into account by political actors, as well as law enforcement agencies, courts while criminological substantiation, prediction of mass resistance measures, and legal assessment of such actions. Value/originality. The authors of the work have improved the criminological vision of the movement of mass resistance, which can take place both in the form of the realization of the natural right of rebellion and in the form of anti-state crimes. The use of these developments can be useful in the retrospective legal assessment of the situation of mass protests, forms, means, and consequences of responding to them by the authorities, preventing abuse of the right of rebellion and related crimes.
This article deals with the development of more accurate models of high-performance pump machines, which are mounted onto the foundation by means of compliant supports. These models demonstrate dependence between support foundation compliance and dynamics of pump elements such as rotor, pump casing and casing of pump bearings. After application of these approaches, the method of vibrational calculation with variable values of support compliance taken into account is provided. This task has been performed by using the multifunctional program complex ANSYS Workbench. In particular, the investigation employs the Modal Analysis subprogram, which implements the finite element method at the tasks of vibration analysis of constructions. The degree of effect of pump baseplate compliance on the rotor dynamics behaviour has been determined. Data charts of dependencies of rotor, pump casing and bearing housings natural frequencies on pump mounting to foundation compliance have been obtained.
This article deals with the development of more accurate models of high-performance pump units which work in a wide range of capacities. The pump operating range can sometimes reach from 20% Qr up to 130% Qr (Qr is the rated capacity). With changes of the pump duty, pressure difference between gap seals is changing as well. This leads to changes of hydrodynamic characteristics of gap seals. In particular, changes in radial stiffness of gap seals have an effect on the rotor dynamics. The task of creating the model has been performed in Modal Analysis subprogram of the ANSYS Workbench multifunctional software complex. Developed model demonstrates a dependence between pump duty and dynamics of the rotor. The nature and extent of influence of pump feed mode on the rotor dynamics has been determined. Data charts of this dependence have been obtained.
The objective of the article is to identify, describe, and explain the essence of terrorism as a general civilizational criminal phenomenon, the characteristics of dimensions of its reproduction and the formation of its concept on this basis. The results of the study provided the grounds for several conclusions. First, ethno-religious terrorism is manifested as a cultural phenomenon, a special segment of the inhumane discourse of hostility and aggressive social practices. It appears as a reaction to the systemic planetary crisis of managing economics, culture, consumption of natural resources, and becomes possible in the result of the massive loss of identity, fragmentation of the world-view. Secondly, we have established that the specified type of terrorism is a segment of aggressive and violent crime, in the collective and psychological basis of which there is the religious and ideological and/or ethnic domination in the systems of socio-political practice, which is achieved through intimidation as a result of committed murders, destruction or damage to property, objects of nature and offenses of a preventive nature (financial, human resources, information, and other provision). Thirdly, ethno-religious terrorism exists within three dimensions: individual (the act of sacrifice, catharsis), group (integration, social orientation) and general (administrative practice, political criminal activity, the postmodern phenomenon of the culture).The applied value of the study is that the suggested vision of the nature and dimensions of ethno-religious terrorism can be used to improve the systemic principles of counteracting its reproduction. The latter should be reflected in the improvement of the provisions of the United Nations Global Counterterrorism Strategy through the consolidation of a coherent, coordinated system of level differentiation of anti-terrorist activities' directions and measures. We note that without changing the basic approaches within the cultural, political, and economic aspects of the interaction of nations and peoples of the world with regard to their diversity and parity, proper autonomy, without stopping the global tendency towards marginalization, it is impossible to effectively counteract to ethno-religious terrorism. Value/originality. The new vision of a complex, multidimensional nature of ethno-religious terrorism has been formed in the work. Its nature is grounded as a civilizational phenomenon reflected on the level of discourse, mass social practices, global managerial strategies. It forms an empirically grounded theoretical basis for increasing the effectiveness of counteracting ethno-religious terrorism in Europe and the world in the whole.
