As mudanças sociais e econômicas do século XIX, que se deram especialmente em razão dos movimentos de industrialização, formam um rico contexto para as investigações que se dão no campo da ciência do direito. Por um lado, há o aumento dos privilégios da burguesia e, por outro, a exploração da força de trabalho e, com ela, desemprego, baixos salários, desigualdade, miséria e aumento da proteção da propriedade privada, tudo sob o aval do Estado. O presente trabalho tem como objetivo revelar a base material do pensamento jurídico, no contexto das relações sociais capitalistas. Trata-se de revisão de literatura narrativa, tendo por objeto de análise os textos de Karl Marx, publicados na Gazeta Renana, no período de 25 de outubro a 3 de novembro de 1842, reunidos sob o título “Os despossuídos”, com nova publicação pela Editora Boitempo no ano de 2017. Verifica-se que, sob a perspectiva marxista, o direito moderno tem como função dar segurança às relações de troca, às relações de trabalho e à propriedade privada e, como tal, expressa-se como ordem jurídica dominante, embora tenha que regular relações sociais aparentemente distanciadas da reprodução econômico-social, como as relações familiares, o meio ambiente e os crimes. Ocorre que esse distanciamento não é senão uma aparência, dada por uma base doutrinária que termina levando à inferência equivocada de que o direito é um campo com autonomia absoluta em relação à reprodução social. Conclui-se que a doutrina política marxista apresenta um conjunto de elementos que revelam o direito como um instrumento de promoção de abstração do sujeito jurídico da realidade social, proclamando uma igualdade jurídica apenas formal, além de ser um reflexo das necessidades e dos interesses da classe dominante.
