O Programa Emergencial de Manutenção do Emprego e da Renda foi uma política pública instituída pelo governo brasileiro em reação às consequências deletérias da pandemia de Covid-19 sobre o mercado de trabalho. O presente artigo tem como objetivo analisar as disputas jurídicas em torno da implementação do Programa Emergencial através de negociações coletivas. A pesquisa foi realizada por meio de: 1) levantamento de contratos coletivos no Sistema Mediador do Ministério da Economia, em que foram encontrados 152 instrumentos coletivos referentes ao programa no município do Rio de Janeiro, firmados entre abril e setembro de 2020; e 2) entrevistas com sindicalistas e advogados de sindicatos que participaram de negociações coletivas relativas ao programa. Os achados da pesquisa apontam para a importância da atuação dos sindicatos na regulação do trabalho e para as consequências do Programa Emergencial em termos de insegurança jurídica e ontológica, uma vez que ele permitiu a suspensão de contratos de trabalho e a redução de jornada e de salário em plena pandemia. Nesse contexto, intensificou-se o unilateralismo patronal como eixo decisório nas negociações coletivas e direitos fundamentais dos trabalhadores foram negociados sob o manto de uma regulação do trabalho de crise.
O presente trabalho busca estudar a participação dos movimentos dos trabalhadores na Assembleia Nacional Constituinte de 1987/1988, no sentido de compreender o modo e a efetividade com que tal processo ocorreu, levando em consideração que a Constituição em questão ficou conhecida como a “cidadã”. Como perspectivas teóricas têm-se o entendimento do direito como reflexo das relações sociais de poder. Foram analisados os movimentos sindicais e suas centrais, especialmente os ligados ao “novo sindicalismo” durante o período da redemocratização, bem como sua influência na construção do texto constitucional, no que tange aos direitos dos trabalhadores, dentro do plenário. O artigo foi escrito a partir de revisão bibliográfica, entrevistas e leitura dos anais da constituinte.
