Introduçãos preços de transferência foram sempre uma grande preocupação dos teóricos de custos e depois de muitos estudos e discussões não há concordância a respeito da forma mais adequada de se transferirem produtos entre divisões de uma mesma empresa, reconhecendo o lucro que deve ser atribuído a cada gerente de divisão.Imagine, agora, que chegue mais um participante interessado neste assunto e que tenha poder de exigir sua parte no bolo. É o fisco que, no Brasil, a partir de 1997, tem a atribuição legal de controlar os preços de transferência praticados entre pessoas físi-cas ou jurídicas vinculadas e cobrar imposto de renda sobre a prática de preços de importação ou exportação classificáveis como inadequados pela legislação vigente.Os aspectos fiscais relativos aos preços de transferência são questões antigas nos Estados Unidos, onde a legislação é extensa e consolidada e leis semelhantes tem sido implantadas também em outros países.A legislação que introduziu o controle dos preços de transferência no Brasil faz parte da evolução do país e se destina a inseri-lo nas normas internacionais. Os poucos artigos da lei tem um alinhamento grande com o que vem sendo praticado no resto do mundo e devem ser interpretados como propositadamente simples para uma fase de maturação posterior. No Brasil, as empresas estão se conscientizando a respeito da importância deste assunto e investindo para organizarem seus sistemas de informação e controle de forma a evitar problemas fiscais. A Secretaria da Receita Federal também está investindo no treinamento de seu pessoal e na evolução de seus sistemas de informação para realizar o controle previsto pela lei.O escopo deste trabalho é a apresentação das normas que vêm sendo aplicadas em outros países do mundo e que tendem a se generalizar, bem como os textos legais existentes no Brasil, sua interpretação, a discussão dos aspectos organizacionais que devem ser cuidados para a implantação de controles em uma empresa. Transfer Pricing nos U.S.A. Os aspectos fiscais dos preços de transferên-cia são tratados na Seção 482 do Código Tributário dos U.S.A. (Internal Revenue Code) cujos termos são:Em qualquer caso de duas ou mais organizações, comércios ou negócios (que podem estar ou não organizados nos U.S.A. e que podem ser ou não possuídos ou controlados direta ou indiretamente pelos mesmos interesses) o Secretário pode distribuir, atribuir ou alocar receita bruta, deduções, cré-ditos ou reduções entre estas organizações, comércios ou negócios se ele determinar que esta distribuição, atribuição ou alocação é necessária para prevenir a evasão de impostos ou claramente para refletir a renda de qualquer destas organizações, comércios ou negócios.
